Dispute Policy

Last Updated: August 2, 2026.

1. Overview

This Dispute Policy outlines how disputes and claims are handled on the Faithfully platform, operated by HotClub Dating Inc., a corporation doing business as Faithfully. We are committed to providing a fair, transparent, and efficient process for resolving disagreements between parties to an agreement.

This policy covers disputes between users about an agreement they made with each other. Disputes between you and Faithfully — about fees, your account, or the Service itself — are governed by Section 16 of our Terms & Conditions.

2. Types of Disputes

2.1 Agreement Violations

A claim can be filed when one party believes the other has violated the terms of their agreement. This includes failure to make payments, breach of agreement conditions, or failure to fulfill agreed-upon obligations.

2.2 Applicable Agreement Types

Claims can be filed for all agreement types on the platform:

  • Relationship Agreements: Violations of fidelity, transparency, or other relationship terms.

  • Loan Agreements: Missed payments, failure to repay, or violation of loan terms.

  • Lease Agreements: Non-payment of rent, property damage, or lease term violations.

  • Service Agreements: Failure to deliver services, non-payment, or quality disputes.

  • Shared Expense Agreements: Failure to contribute, misuse of shared funds.

  • Promissory Note Agreements: Failure to honor note terms or payment obligations.

  • Item Borrow Agreements: Failure to return items, damage to borrowed items, or late returns.

  • Financial Support Agreements: Missed or discontinued support payments, or violation of support terms.

3. Filing a Claim

3.1 Who Can File

Either party to an agreement — the agreement creator or the other signatory — may file a claim against the other party.

3.2 Claim Requirements

To file a claim, you must provide:

  • A description of the alleged violation.

  • The amount being claimed, if applicable.

  • Supporting evidence such as photos, screenshots, documents, correspondence, or other relevant proof.

3.3 Time Limit

For an agreement that has been completed, a claim must be filed within 30 days of completion. After that window closes, claims can no longer be filed through the platform, though this does not affect any rights you may have outside it.

3.4 Claim Fee

A platform fee of 1.5% of the claim amount, with a minimum of $1.50, is charged when filing a claim. This fee is deducted from the claim payout if the claim is approved. If the claim is denied, the fee is non-refundable.

3.5 Minimum Claim Amount

The minimum claim amount is $1.00.

4. Response Process

4.1 Notification

When a claim is filed, the responding party receives a notification in the App and by email.

4.2 Response Period

The responding party has 72 hours to:

  • Accept the claim: Acknowledge the violation and agree to pay the claimed amount.

  • Dispute the claim: Provide counter-evidence and their side of the story.

  • No response: If they do not respond within the deadline, the claim may be processed based on the available evidence.

4.3 Responding Party Evidence

The responding party may upload counter-evidence including documents, photos, or explanations that refute or address the claim.

5. Claim Resolution

5.1 Accepted Claims

If the responding party accepts the claim, the claimed amount, less the platform fee, is transferred to the claimant.

5.2 AI-Assisted Review

When a claim is disputed, it undergoes AI-assisted review. The AI system evaluates:

  • The terms of the agreement.

  • Evidence submitted by the claimant.

  • Counter-evidence submitted by the responding party.

  • The specific nature of the alleged violation.

The AI provides a recommendation to approve or deny, with reasoning. As described in our Privacy Policy, agreement terms and claim evidence may be sent to third-party AI providers for this analysis. As described in our Terms, AI does not determine legal fault.

5.3 Administrative Review

Claims may be escalated to manual review by Faithfully administrators where:

  • The AI review is inconclusive.

  • The claim involves complex circumstances.

  • Either party disputes the AI recommendation.

  • The claim involves a significant amount.

5.4 Deadline Processing

If the responding party does not respond within the deadline, the claim is processed based on the available evidence, which may include AI review.

6. Payouts and Transfers

6.1 Approved Claim Payouts

When a claim is approved:

  • The claimed amount is charged to the responding party's linked payment method.

  • The platform fee of 1.5%, minimum $1.50, is deducted.

  • The remaining amount is transferred to the claimant's connected bank account.

6.2 Failed Transfers

If a transfer to the claimant fails, for example because of an issue with their payout account, the responding party is automatically refunded.

6.3 Failed Debits

Claim amounts are collected by ACH bank debit. If that debit is returned by the responding party's bank, the claim payment does not complete and a returned payment fee may be assessed as described in our Refund Policy. The underlying obligation is not discharged by a failed debit.

6.4 Processing Time

Claim payouts are processed through Stripe and follow standard payout timelines, typically 2–7 business days depending on the payout method.

7. Appeals

If you believe a claim decision was made in error, contact support@faithfullyapp.com with:

  • The claim reference or agreement ID.

  • The reason you believe the decision was incorrect.

  • Any additional evidence not previously submitted.

Appeals are reviewed by Faithfully administrators on a case-by-case basis.

8. Important Notices

8.1 Not Legal Arbitration

Faithfully's dispute resolution process is a facilitation service. It does not constitute legal arbitration, mediation, or any form of legal proceeding, and it does not produce a judgment. Decisions made through the platform do not prevent either party from pursuing legal remedies through the courts.

8.2 Good Faith Participation

Both parties are expected to participate in the dispute resolution process in good faith. Filing false claims, submitting fabricated evidence, or abusing the dispute system may result in account termination.

8.3 Limitation

Faithfully's dispute resolution is limited to the terms and conditions specified within agreements created on the platform. We cannot resolve disputes that fall outside the scope of the agreement, and we do not verify the authenticity of submitted evidence.
